Thanks. I am in full agreement with your press release. Occasionally I have tried to make my view through writing on the law and politics of Nepal. I assume some of you already know my view about Nepal's current political situation. Recently, I had sent a draft article to different news papers. Some have published it, e.g. the Himalayan Times have extensively edited the article, and nepalnews.com have changed some words hare and there. Someone have even translated this artlce in Italian language(see, http://www.resistenze.org/sito/te/po/ne/pone9e12-005023.htm). I am not sure who and why one can be interested reading this in Italian?

 

However, I am interested to share my thoughts and legal ideas with all of you. And, those friends who have not read the article or wish to know about my views, please have a look on the following web

agreed.

it is really humiliating situation to the citizens of independant nepal that a rejected one have been put on the head of citizens under the consipiracy by the foreign elemnts with their vested interest. so we have very little hope that our new constitution will be as desired by the citizens.

I have got an opportunity to go through the press release of NACSS. I really do not know whether the by-laws of so called NACSS allows to make such political statement.

I appreciate few of the points raised in the statement like " Open Interferences by the Indian envoy Mr. Sood". I also personallly felt why & how this Indian envoy dared to interfere openly and directly in the internal affiars of Nepal ? No sovereign Nepalese people would tolerate this nor we should. It hurts our proud Independednt stature of Nepal. But my question to Immediate Past Prime Minister Prachanda was " Why he had given inemerous times of appointment to the Indian envoy Mr. Sood ? Mr Sood had a record meeting of Prachand 7 times within 4 days in the fag end of Prachanda's tenure. What Mr. Prachanda even did not have guts to refuse the appointment request ? Mr Prachand

must not have entertained him of meeting personally so many times in his chamber. If our own Prime Minister allowed him to interfere then can we callit an interference?

Definitely Mr. Madhav Nepal was rejected by the people of two consitituencies but definitely not rejected by the entire 25.5 million Nepalese people. At least Mr Madhav Nepal is having a bit patriotic feelings being a Nepales and he is not traitor. He nev er killed his own people, he never tried to demorilse the proud Nepales Army , He never raised the parallel army and he has never been a double tounge leader unlike Prachand! I do not understand how Prachand was advocating and talking high about the people's supremacy in the existing Praliamentary democracy ? His own people's liberation army was never under the Parliament and under such situation also the people's supremacy was oppressed and suppressed.

It seems NACSS do not have the above information!. If it does then the press statement released by NACSS is a politically motivated statement.

Press Release:

The rapidly changing scenario of the political drama in Nepal has witnessed the nomination of a second PM in 9 months since the formation of the Constituent Assembly in April 10, 2008. Taking advantage of the loop-holes and anomalies built into the election rules and processes of the new Constituent Assembly, the Nepalese people and the world sees the nomination of a person to the highest and most powerful office of the country who was convincingly rejected by the popular vote in the recent CA polls.

The abrupt resignation of the first elected PM embroiled in the unsuccessful firing fiasco of the Nepal Army chief and few other generals, has played into the hands of the waiting political bosses who spared not a single breath in taking full advantages of this loop-hole and weakness in the rules and put into place a person of their choice which has come to happen by the initiation of the Nepali Congress, the Indian activist envoy and the 22 parties of the coalition who in turn are hoping to see some cabinet seats come their way.

This Centre, along with the people of Nepal, is extremely concerned, and quiet frustrated, at the game played here at this important juncture of nation building. The Centre believes that this episode has diminished the trust and confidence of the people in this Constituent Assembly and its members as they dwell in this kind of procedural manoeuvres instead of being honestly involved in drafting a proper Constitution of the country and building the nation for which they were elected for.

The ever-presence and re-cycling of the same old politicians, and constant influence of the external forces, specially the activism of the Indian envoy in this case, is jeopardising the gains made by the people in the last election of the CA and are now hindering the people from honestly exercising and executing the process of democratic reforms and establishing of their desired Federal Republic of Nepal.

The responsibilities of this strange and uncertain situation can be levied on to all sides, one, the incompleteness and weaknesses of rules and regulations of the election process, two, the integrity and honesty of the party bosses dis-concerned about the consequences of such actions, and, three, the people themselves could not figure out what is to be done with these “Forever Re-cycling Leaders” that haunts the house of Nepal from the fifties.

When the highest and the most powerful position of the government is at stake, no moral, ethical, or constitutional stones should be left unturned by the people to make sure that the high standard of trust, honest, and morality be applied to get the best leader the people’s votes can get. People of Nepal is “hiring these politicians” to do the worthy and honourable work of building a strong and a good nation, and expect a lot of hard work and honesty from them. Unfortunately, in return the people are told lies, with rampant dishonesty, corruption and cheating of the dignity and wealth of the Nepalese people. The power of the peoples’ vote must be honoured and respected by the party bosses and in this case they have not, and in-fact, they have blatantly disrespected them. Once again they have opted for greed and power and nominated one of their own in total disregard of the people’s rejection of this very candidate twice in the CA elections (Kathmandu2 and Rautaghat6 districts). The loophole in the CA election rules has lead to this nomination which will be considered unconstitutional and unethical in a normal situation but is not in the present situation because the CA election rules has been crafted such that an unelected members can be the head of a government. The people has been mislead here. Service to the country is a privilege given to the elected by the people, a lifetime of opportunity for the leaders to make a name for oneself by serving the people well and not be involved in unnecessary activities that weakens the country.

It has been widely understood that the role of the President of the Nepali Congress Mr. Girija P. Koirala is of particular significance here. With support and cooperation, particularly, of the Indian Emvoy Mr Sood, and other members of the diplomatic corps from different countries has made this possible in nominating a compromise but weak leader, Mr. Madhav Nepal, who will not be able to serve the people and the country well. Firstly, because of his obligations to his mentors whom he must serve them well, and secondly he does not have the mandate of the people as he was defeated twice by the people and clearly they do not want him as their leader. We do not have to wait for history to tell us that these leaders will throw “ Democracies” out the window when it comes to self-interest and power grab.

The Nepalese people also expects that the neighbouring governments and their envoys play a constructive role in the building of this emerging Federal Republic of Nepal and must make no attempt to meddle and interfere in the internal affairs of Nepal.
Friendship, mutual understanding, and cooperation are best served, to both the people of India and Nepal, if everything is kept open and honest.

This Centre sees great harm done to the country of Nepal by this action. Despite the support of the coalition of the 22 parties and other important personalities, this government will not last long enough as squabbles have already broken out amongst the ranks for the slice of the pie of cabinet posts that make of the government. The country is paying a heavy price for this mis-step, the trust has been broken, the integrity has been compromised, the Constitution writing process uncertain, the daily life handicapped and hampered and many more, all in the name of the “15 minute of fame” for the new Prime Minister who comes to the highest office of the country, thumbing his nose to the people of Nepal and is least worried what the people of Nepal and the world thinks about him as a leader.
